The Motortopia member who wins the most challenges between April 1, 2007, and April 30, 2007, will win a Jay Leno autographed cap along with a Tonight Show T-shirt, towel, coffee mug, pens and notebook.
The Motortopia Inc. Challenge Contest
OFFICIAL RULES
NO PURCHASE NECESSARY TO WIN, NOR WILL A PURCHASE IMPROVE ONES CHANCES OF WINNING. MUST BE 18 YEARS OF AGE OR OLDER.
1. Eligibility/Entries: The Motortopia Inc. Challenge Contest is open to persons who are at least eighteen (18) years of age before the start date of the contest and must be a member of Motortopia. Employees of Motortopia Inc., The Tonight Show, NBC, NBC.com, their subsidiaries, affiliates, sales representatives, distributors, and members of each of their immediate families (spouses, parents, grandparents, children and siblings, and their respective spouses) and those living in the same household of each are not eligible. Participation in the Contest constitutes entrants full and unconditional agreement to, and acceptance of, these Official Rules. Winning a prize is contingent upon fulfilling all requirements set forth herein. Giveaway begins at 12:00 AM CT on April 1, 2007, and ends on-line at 11:59 PM CT on April 30, 2007. A person is only eligible to win one Challenge Contest every three (3) months.
Challenges must be accepted by 11:59 PM CT on April 25, 2007, in order to end and be counted by 11:59 PM CT on April 30, 2007, for winner to receive credit. Motortopia has the right to disqualify any member from the contest if there is any sign of, but not limited to: creating fake accounts, using false information, etc. Entrants must be an Authorized account holder of the Motortopia Account as defined as the natural person who is assigned to the email (the account is held under) address by an Internet access provider, online service provider, or other organization which is responsible for assigning email addresses for the domain associated with the submitted email address. Proof of being the authorized account holder may be required. Winners of the prizes must be willing have their picture taken and posted Motortopia as the contest winners. Must be 18 years or older to win. Winner will be posted on the site by May 8, 2007.
In the event of a tie, the overall number of challenge points accumulated during the contest period will be used as a tiebreaker. If there is a further tie, a random drawing will be used as the final tiebreaker.
2. PRIZES/ODDS: Grand Prize: (1) Jay Leno autographed cap along with a Tonight Show T-shirt, towel, coffee mug, pens and notebook. Odds of winning depend upon the total number of challenges/participants. Winner is responsible for all taxes, and any other fees associated with acceptance of the Grand Prize.
3. Limitations of Liability: Sponsor and its agents are not responsible for any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Giveaway; lost, late, damaged, misdirected, illegible, incomplete entries any computer, on-line, telephone or technical malfunctions, delays or human errors that occur in the processing, transmission or receipt of entries, or for inaccurate transcription of entry information, or for entries that are stolen, misdirected, garbled, lost or delayed by computer transmissions. If, for any reason, the Giveaway is not capable of being conducted as planned, including but not limited to infection by computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond the control of Sponsor, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Giveaway. Sponsor also reserves the right, in its sole discretion, to disqualify any individual found to be violating these Official Rules or suspected of attempting to disrupt or defraud the entry process or the operation of the Giveaway, and Sponsor may prosecute or seek other legal redress against anyone suspected of engaging in these acts.
4. Prize Acceptance: Prizes are not transferable or assignable. No substitution or cash redemption allowed except by Sponsor, who may substitute a prize of equal or greater value if advertised prize becomes unavailable. All taxes, including federal, state and local taxes, are the sole responsibility of winner who may be issued an IRS 1099 tax form (winner is advised to seek independent counsel regarding prize winnings). Winner will be required to sign and return an Affidavit of Eligibility/Release of Liability and Publicity (where permitted) within fourteen (14) days of notification. If a potential winner cannot be contacted within (14) fourteen days, after the first attempt to contact the potential winner, if the potential winner does not sign and return the Affidavit of Eligibility/Release of Liability and Publicity (where permitted) in the required time period, or if a prize is returned as undeliverable, the prize will be deemed forfeited and an alternate winner will be selected from among all remaining eligible entries received. Any prizes won by a minor will be awarded in the minors name to his/her parent or legal guardian who must sign and return all required documents.
By accepting prize, winner consents to use of name, state of residence and likeness for advertising and promotional purposes on-line and in print, or in any other media worldwide in connection with the Giveaway, without limitation and without additional compensation worldwide, except where prohibited by law. By accepting prize, winner further agrees to release Sponsor and its subsidiaries, affiliates and related companies and each of their respective officers, directors, employees and agents, from any and all liability, loss or damage of any kind arising out of or in connection with winners; participation in this Giveaway, or with respect to the awarding, receipt, possession, use and/or misuse of any prize, or the participation in prize-related activities. By accepting prizes, winner further acknowledges that the Giveaway Parties have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied in fact or in law, relative to prize or to any portion thereof, including but not limited to its quality, merchantability, mechanical condition, or fitness for a particular purpose. By accepting prize, winner agrees their name and mailing address may be used for promo/sales purposes by the Sponsor and its subsidiaries, affiliates and related companies and each of their respective officers, directors, employees and agents.
5. Award Process Winners: Contest winners will be contacted via private message from Motortopia Garage. After participant responds and provides Motortopia with participant address participant will receive product within thirty (30) days.
